Medellín 16/08/20 – Los trabajos para construir el tramo 2B del Metroplús en el municipio de Envigado volvieron a quedar en el limbo luego de que el Juzgado Trece Administrativo Oral de Medellín emitiera unas medidas cautelares y ordenara suspender la obra.
La decisión se conoció el pasado sábado 15 de agosto, cuando el colectivo ciudadano Túnel Verde, que desde hace varios años critica el componente ambiental de ese proyecto, publicara apartes de dicha medida judicial.
Hilda Castaño, portavoz del Colectivo Túnel Verde, explicó que la acción popular fue impulsada por la Red de Defensores del Patrimonio del Valle de Aburrá, una organización ciudadana especializada en la promoción de los derechos culturales que no guarda ninguna relación con el colectivo.
Según explicó Castaño, el valor de esa acción radica en que abrió un nuevo frente en la batalla judicial que desde hace más de seis años varias organizaciones de la sociedad civil libran en contra de la Alcaldía de Envigado, la empresa Metroplús y las autoridades ambientales, para evitar que los árboles que componen ese corredor verde sean talados y así dar paso a un tercer carril de la avenida El Poblado.
Según explica, luego de revisar las miles de páginas que componen los planes de ordenamiento territorial locales, la Red de Defensores encontró razones suficientes para plantear que aquel corredor debería ser considerado como patrimonio cultural y no podría ser intervenido
“Lo que hemos venido reiterando es que la construcción de ese sistema de transporte venga acompañada de la conservación ambiental”
“La medida cautelar que ha decretado el juzgado detiene todo tipo de obra, no solamente las intervenciones ambientales. Nos mantenemos alertas y a la expectativa de lo que pasará con este proceso. Esto es un precedente muy importante en el cuidado del patrimonio histórico y cultural del municipio”, dijo Castaño.
Aunque la admisión de la demanda no implica una decisión de fondo, las nuevas medidas cautelares significan un nuevo revés para la Alcaldía de Envigado y la empresa Metroplús, que esperaban reanudar los trabajos de ese proyecto a partir del 21 de agosto de este año.
Cabe recordar que el tramo 2B del Metroplús hace parte de un proyecto con el que se pretende construir una nueva línea de buses tipo BRT, que conectaría a los municipios de Sabaneta y Envigado con el Sistema Metro de Medellín. La obra viene atascada desde 2013, a raíz de un conjunto de acciones judiciales.
Durante ese año, cuando parecía inminente el inicio de los trabajos, un grupo de ciudadanos interpusieron una acción judicial ante el Tribunal Administrativo de Antioquia que ordenó suspender la tala.
Aunque el proyecto no avanzó por mucho tiempo, dado que el permiso de aprovechamiento forestal emitido por Corantioquia había sido suspendido por orden judicial, la entrada de Envigado al Área Metropolitana del Valle de Aburrá, el 26 de julio de 2016, cambió el panorama de la obra.
En calidad de nueva autoridad ambiental, reemplazando las funciones que antes cumplía Corantioquia, el Área Metropolitana emitió el 5 de abril de 2019 una nueva resolución que permitía talar el corredor verde para reanudar los trabajos.
La admisión de esta nueva demanda supondría que esa autorización entraría de nuevo bajo revisión judicial.
“Nosotros no nos oponemos al proyecto Metroplús. Lo que hemos venido planteando reiteradamente es que la construcción de ese sistema de transporte venga acompañada del mantenimiento y la conservación ambiental”, reiteró Castaño.
El Municipio de Envigado manifestó que hasta no estudiar la determinación judicial no emitirá ningún pronunciamiento. De igual forma, la empresa Metroplús aún no se ha referido al tema.
