COMUNICADO 1 – 2018
Metroplús S.A. como entidad responsable de la construcción del Tramo 2B en el municipio de Envigado, que actualmente se encuentra suspendida, y con ocasión del fallo del Consejo de Estado notificado el pasado 21 de febrero del presente año, se permite informar:
- Que somos respetuosos de los fallos de las autoridades judiciales.
- El fallo de segunda instancia del Consejo de Estado aceptó el desistimiento del recurso de apelación interpuesto por Metroplús contra la sentencia del 11 de abril de 2014, proferida por el Tribunal Administrativo de Antioquia.
- La sentencia del Consejo de Estado revoca el numeral tercero del fallo de primera instancia, en el cual se había ordenado la suspensión de los efectos de la resolución de Corantioquia que autorizaba el aprovechamiento forestal, ordenando realizar un nuevo concepto técnico. Esta decisión se fundamenta en el desistimiento de Metroplús S.A. de la solicitud de aprovechamiento forestal, inicialmente presentada ante Corantioquia, la cual fue aceptada por el Área Metropolitana cuando asumió su competencia como autoridad ambiental del municipio de Envigado.
- El fallo anotado revocó, igualmente, la condena en gastos de defensa (costas) a Corantioquia y Metroplús, debido a que no hay prueba que acredite que los demandantes hubiesen incurrido en gastos necesarios para el desarrollo del proceso, más aun si se tiene en cuenta que les fue concedido el amparo de pobreza.
Desde Metroplús S.A. seguiremos convencidos que los sistemas de transporte público son la alternativa para una movilidad inteligente, que permita minimizar la contaminación por el uso de combustibles fósiles, siendo así la apuesta por la sostenibilidad de nuestro territorio. Todas nuestras acciones orientadas desde nuestros accionistas y la Junta Directiva, conformada por el Gobierno Nacional, los municipios de Medellín, Envigado e Itagüí, Metro de Medellín Ltda, Terminales de Transporte S.A. e IDEA, se encuentran en el marco de la importancia al desarrollo de estos sistemas de transporte. Continuaremos buscando alternativas de la mano con los municipios, autoridades de transporte y autoridades ambientales, que nos lleven a la implementación de soluciones sostenibles para la movilidad en nuestro Valle de Aburrá, en beneficio de nuestra comunidad.
