Ante los recursos de apelación interpuestos por Metroplús S.A., el Municipio de Envigado y el Área Metropolitana, el Tribunal Administrativo de Antioquia (Sala Tercera de Oralidad), en un fallo judicial de segunda instancia, revocó la medida cautelar dispuesta por el Juzgado 13 Administrativo Oral de Medellín en auto del 14 de agosto de 2020, que suspendía la construcción de un tercer carril y un paradero de buses sobre el tramo 2B de metroplús, en el corredor verde de la carrera 43 A de Envigado.

El pleito ajusta más de siete años. Actores populares, en diciembre de 2019, advirtieron que el Municipio de Envigado inició la tala de árboles en el corredor verde, lo que ensanchó, desde entonces, las causales de discordia.

Emprendieron, así, una acción popular que reclamaba el amparo de derechos colectivos “que el proyecto había violentado”, como el goce del patrimonio cultural, del espacio público y el acceso a un ambiente sano; la utilización y defensa de los bienes de uso colectivo; y el balance entre el derecho a un desarrollo urbano ordenado, que privilegie la calidad de vida de los habitantes.

Los argumentos

La Acción Popular exigía tres cosas puntuales: (1) que se suspendiera de manera “inmediata” el contrato o acto administrativo que permitía la construcción del paradero de buses y tercer carril, por afectar el corredor, considerado como “bien de interés cultural”; (2) suspender los efectos de la Resolución Metropolitana 740 del 5 de abril de 2019 y otras que pudieran deteriorar el arbolado de la zona; y, (3), prohibir cualquier tipo de tala de árboles en el corredor, considerado “sector de conservación paisajística y con declaración patrimonial”.

El juzgado, en primera instancia admitió las razones de los demandantes y suspendió las obras. También indicó que debía revisarse la resolución que otorgó el permiso de aprovechamiento forestal y sus estudios previos, para verificar si fueron idóneos y cumplían con las medidas de compensación ecológica necesarias ante posibles daños por la intervención.

La apelación

Sin embargo, Metroplús S.A., Municipio de Envigado y Área Metropolitana apelaron la medida cautelar. En esta segunda instancia, el Tribunal Administrativo de Antioquia encontró improcedentes las argumentaciones de los demandantes y, por tanto, la decisión tomada por el juzgado.

Explicó en su fallo que en el procedimiento para declarar un bien de interés cultural se requiere de la existencia de un acto administrativo gestionado por el ente territorial específico. El fallo señala que hay ausencia de pruebas para que el corredor de la 43 A sea considerado como bien de interés cultural: “dicho bien, en principio, no requiere de una protección especial, al no tener previamente aprobado un plan especial para su manejo y protección”.

Respecto a la Resolución por medio de la cual el Área Metropolitana otorgó al Municipio de Envigado una autorización para el aprovechamiento “de árboles aislados de los individuos arbóreos”, la segunda instancia expresó que esta partió de un estudio serio y bien fundamentado, y fue emitida sin irregularidad alguna: “No se entiende cómo un acto administrativo en firme, que autorizó la tala, reubicación o trasplante de árboles aislados localizados en centros urbanos, para la realización (…) de obras públicas o privadas de infraestructura (…) permita extraer conclusiones diferentes y contrarias a la preservación del interés paisajístico”.

Respuestas de las partes

Frente al nuevo fallo, la Alcaldía de Envigado no respondió. Dijo que la vocería del tema la tenía Metroplús, “quienes son los responsables directos de la obra”. Este último, por su parte, indicó que no se pronunciaría hasta la próxima semana, pues esperan que la notificación formal del fallo sea remitida a su gerente, James Enrique Gallego.

Faber Cuervo, del colectivo Túnel Verde, señaló que no comparten los argumentos interpuestos para revocar la suspensión de las obras: “Sí hay una medida técnica fuerte, avalada por el régimen que regula el otorgamiento de permisos de aprovechamiento forestal, es la ley 1185. Hay irregularidades. Nos están desconociendo los derechos colectivos a un medio ambiente sano, el espacio público y el bien patrimonial”.

Dijo, también, que el Área Metropolitana cometió irregularidades en la concesión del permiso de aprovechamiento forestal “para la tala de 132 árboles; y que morirán, en definitiva, 150, por las pruebas agresivas”.

Agregó que la respuesta ante la demanda, por parte de Metroplús y la Alcaldía de Envigado, “ha sido una campaña desinformativa, en la que indican que algunos ciudadanos buscan interrumpir la continuación de la obra”.
